Terms of Service

These Terms of Service ("Terms") are an agreement between you and GASEFC LLC, doing business as Growth Automations ("Growth Automations", "we", "us", or "our"), and govern your use of the Growth Automations platform at growthautomations.com (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Service Description

Growth Automations provides a website building and hosting platform. The Service allows you to create, edit, and publish websites using templates, manage content through a portal or connected tools (e.g., Notion), connect third-party integrations, and access AI-assisted content features.

2. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 16 years of age to use the Service.
  • One person may not maintain more than one free account.
  • You are responsible for all activity that occurs under your account.

3. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Publish content that is defamatory, obscene, or promotes violence
  • Distribute malware, spam, or phishing content
  • Infringe on the intellectual property rights of others
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Use the Service to send unsolicited bulk communications
  • Interfere with or disrupt the integrity or performance of the Service
  • Scrape, crawl, or use automated means to access the Service without permission

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice, depending on the severity of the violation. The full list of prohibited and restricted content — including categories that require manual review — is set out in our Acceptable Use Policy, which is part of these Terms.

4. Your Content

You retain ownership of all content you upload, create, or publish through the Service ("Your Content"). By using the Service, you grant us a limited license to host, display, and distribute Your Content solely to provide the Service.

You may export Your Content at any time via the "Download my data" option in your account settings. We provide a machine-readable bundle including your account and site configuration, brand profile, wizard responses, and subscription and billing history, per GDPR Article 20 (right to data portability). Media files and the underlying source repository are handled separately, as described in our Site Export & Data Takeout Policy.

Upon account closure, Your Content is retained during the closure grace and cold-storage windows described in Section 12, then archived or anonymized per our data retention policy. Billing records are retained for up to 10 years where required by tax law.

5. Third-Party Integrations

The Service allows you to connect third-party accounts (Google, Microsoft, Meta, Notion, and others). When you connect a third-party service:

  • You authorize us to access the specific data scopes you approve
  • You are subject to that third party's terms and privacy policy
  • You may revoke access at any time through your account settings or the third party's dashboard
  • We are not responsible for the availability or actions of third-party services

6. Plans and Payments

  • The Service offers free and paid plans. Features available on each plan are described on our pricing page.
  • Paid subscriptions are billed in advance on a recurring basis (monthly or annually).
  • All payments are processed securely through Stripe.
  • You may cancel your subscription at any time. Access continues until the end of the current billing period.
  • Refunds are handled on a case-by-case basis. Contact support for refund requests.
  • We reserve the right to change pricing with 30 days' notice.

Full billing, renewal, cancellation, and refund details are set out in our Subscription, Renewal, Cancellation & Refund Policy. Domains purchased through the Service are governed by our Domain Registration & Management Terms.

7. Intellectual Property

The Service, including its design, code, templates, branding, and documentation, is owned by Growth Automations and protected by intellectual property laws. Templates provided through the Service are licensed for your use on the platform under our Template License Terms; they may not be redistributed or resold. To report content you believe infringes your copyright, see our Copyright / DMCA Policy.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We are not liable for any downtime or data loss resulting from service interruptions.

9. Limitation of Liability

To the maximum extent permitted by law, Growth Automations shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising from your use of the Service. Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Indemnification

You agree to indemnify and hold harmless Growth Automations from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Account Closure and Termination

You may close your account at any time from your account settings. We may suspend or terminate your account if you violate these Terms. Provisions that by their nature should survive (including intellectual property, limitation of liability, and indemnification) will remain in effect after termination.

Closure is a staged progression — you are not locked out the moment you click "Close account." Each stage is designed to give you time to reconsider or recover your data:

  • Grace period (30 days) — after you initiate closure, your account enters a 30-day grace window. You retain read-only access: you can download your data, view billing history, and reactivate your account with a single click. Your sites stay live. Write actions (editing, saving, new sites, AI generation) are disabled during this window. You may reactivate at any time within the 30 days.
  • Cold-storage period (60 days after grace) — if you do not reactivate, we cancel active subscriptions, take your sites offline, archive connected repositories, and revoke integrations. You can no longer log in. An administrator can still restore your account on request during this 60-day window. After that, recovery is no longer available through normal support channels.
  • Archival (after cold-storage) — your account and content are permanently archived. Personal data is anonymized two years after archival pursuant to GDPR Article 17 (right to erasure), except where retention is legally required. Billing records (invoices, receipts) are retained for up to 10 years as required by tax law.

Exceptions. We reserve the right to bypass the grace period for (a) accounts identified as fraudulent, (b) accounts violating our Acceptable Use policy requiring immediate termination, or (c) legally binding erasure requests that require expedited compliance. Administrative closures in these categories proceed directly to teardown without the grace window.

Upon completion of closure, your right to use the Service ceases. If you wish to use the Service again after archival, you are welcome to register a new account.

13. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Hernando County, Florida.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or a prominent notice on the Service at least 30 days before they take effect. Continued use after changes constitutes acceptance.

If you submit templates to the marketplace as a developer, the Developer Submission Agreement and Developer Payout Terms also apply. If any of these documents conflicts with these Terms on a specific topic, the more specific document controls for that topic.
